MyFamily Canada Terms and Conditions

These Terms and Conditions (the "Terms") govern your use of b2b.myfamily.ca (the "Website"), related online forms, business accounts, services, and text messaging programs operated by 9102-1113 Québec Inc., doing business as MyFamily Canada ("MyFamily Canada," "we," "us," or "our"). By using the Website or a related service that links to these Terms, you agree to them.
If you do not agree to these Terms, do not use the applicable website or service. Mandatory rights available under applicable consumer protection or other laws are not limited by these Terms.
About MyFamily Canada
MyFamily Canada is the independent Canadian distributor of MyFamily pet identification products, engraving systems, accessories, and related products and services. The Website is our Canadian business-to-business website for retailers, prospective retail partners, and other business customers. Our contact information appears at the end of these Terms.
Business Customers
The Website is intended primarily for businesses and their authorized representatives. Public information may be viewed without an account, but wholesale account registration, business pricing, and ordering features may be restricted to approved business customers. Applying for an account does not guarantee approval. We may request information reasonably needed to verify a business, assess account eligibility, establish purchasing terms, or prevent fraud.
Using Our Websites and Services
You may use our websites and services only for lawful purposes and in accordance with these Terms. You must not interfere with security, attempt unauthorized access, introduce malicious code, scrape or copy content through automated means without permission, impersonate another person, submit false information, or use our services in a way that infringes the rights of another person or organization.
You are responsible for ensuring that information you submit is accurate and that you are authorized to provide it. If you use our services on behalf of a business or other organization, you confirm that you have authority to bind that organization to these Terms.
Accounts

You are responsible for safeguarding your login credentials and for activity under your account. Notify us promptly if you suspect unauthorized access or use. We may suspend or close an account where reasonably necessary to protect our systems, users, or legal rights, where account information is inaccurate, or where these Terms have been breached.
Product and Service Information
We try to present product descriptions, images, specifications, availability, and other information accurately. Colours and appearance may vary by screen or production batch. We may correct errors, update information, change or discontinue products or services, and limit quantities where permitted by law.
Orders Prices and Payment
Submitting an order is an offer to purchase. An order is accepted when we confirm acceptance or fulfill it. Quotes, account-specific pricing, minimum quantities, credit terms, and other commercial terms may apply to a business account. We may decline or cancel an order where permitted by law, including for errors, suspected fraud, payment or credit issues, inventory limitations, or shipping restrictions. If we cancel after payment, we will provide the refund required by law and our applicable policies.
Unless stated otherwise, prices are in Canadian dollars and may be shown before applicable taxes and shipping charges. Taxes, shipping, and other disclosed fees are added as shown on the order, invoice, or quote. Payments may be processed by third-party payment providers under their own terms and privacy policies.
Shipping Pickup Returns and Warranties
Shipping and pickup estimates are provided in good faith but may be affected by carriers, inventory, weather, customs, and other circumstances outside our reasonable control. Risk and ownership transfer as provided by applicable law and the terms presented during the transaction.
Returns, exchanges, refunds, engraving or personalization restrictions, and warranties are governed by the policies presented with the relevant product or transaction and by applicable law. Personalized or engraved products may be subject to different return conditions where permitted by law. Nothing in these Terms removes a warranty or remedy that cannot legally be excluded.
Text Messaging Program
The MyFamily Canada text messaging program may provide customer care messages, product and service information, event information, reservation or order updates, pickup reminders, and promotional messages, depending on the consent you provide.
Consent
By affirmatively opting in, you authorize MyFamily Canada and its messaging service providers to send text messages to the mobile number you provide. Consent to receive promotional text messages is not a condition of purchase. You confirm that you are the subscriber or customary user of that number and are authorized to provide consent.
Message Frequency and Charges
Message frequency may vary based on your interactions with us and the communications you selected. Message and data rates may apply according to your mobile plan. Your carrier may impose other charges or restrictions.
Opting Out and Getting Help
Reply STOP to opt out of text messages. After you opt out, we may send one confirmation message. Reply HELP for assistance, email info@myfamily.ca, or call +1 514-360-1945. Other recognized opt-out words may also be honoured where required.
Delivery and Mobile Numbers
Text message delivery is subject to network availability and is not guaranteed. Mobile carriers are not responsible for delayed or undelivered messages. If you change or transfer your mobile number, you must opt out before the change or notify us so that messages are not sent to the new user of the number.
Text Messaging Privacy
Our collection and use of information through the text messaging program are governed by our Privacy Policy. We do not sell or share mobile numbers, SMS opt-in data, consent records, or text message data with third parties or affiliates for their own marketing or promotional purposes. We may use messaging platform providers, carriers, and other service providers only as necessary to operate the program and comply with legal or carrier requirements.
Commercial Electronic Messages
Where Canada's Anti-Spam Legislation applies, we send commercial electronic messages only with the consent or other lawful basis required by law. Messages will identify the sender and provide a working unsubscribe mechanism. You may withdraw consent at any time.
Intellectual Property
The websites and their content, including trademarks, logos, text, product names, photographs, graphics, designs, software, and layout, are owned by or licensed to MyFamily Canada and are protected by intellectual property laws. You may use the websites for their intended purpose. You may not reproduce, modify, distribute, sell, license, or commercially exploit protected content without the permission of the applicable rights holder.
User Submissions
If you submit reviews, comments, photographs, or other content, you remain responsible for that content and confirm that you have the right to provide it. You must not submit content that is unlawful, infringing, defamatory, deceptive, abusive, or harmful. Where needed to provide the requested service, you grant us a non-exclusive permission to use, reproduce, and process the submitted content for that purpose.

To the extent permitted by law, MyFamily Canada and its directors, employees, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of a website or service. This limitation does not apply where liability cannot legally be excluded or limited, including any mandatory consumer protection rights.
Governing Law
These Terms are governed by the laws of Quebec and the federal laws of Canada applicable in Quebec, without limiting any mandatory rights available under the laws that apply to you. Any dispute will be brought before a court with jurisdiction under applicable law.
Severability and No Waiver
If a provision of these Terms is found invalid or unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
Changes to These Terms
We may update these Terms from time to time. We will post the updated version with a new effective date and provide any additional notice required by law. Continued use after the effective date means you accept the updated Terms, except where additional consent is required.
